Parole in Place (PIP) is a discretionary policy that grants lawful presence to undocumented spouses, parents, and children of active duty service members, veterans, and reservists. Once granted, PIP allows your family member to apply for adjustment of status without leaving the country. Eligibility and availability depend on current DHS policy, and we assess your specific situation during consultation.
INA §328 covers peacetime military service — it requires one year of honorable service and reduces the residency requirement. INA §329 covers service during designated periods of hostility (including the post-9/11 period) and eliminates the residency and physical presence requirements entirely. Which one applies to you depends on when and how you served.
A PCS doesn't automatically transfer your case to a new USCIS field office. If your interview or biometrics are already scheduled, they may still be at your old duty station. We proactively manage jurisdiction transfers so your case follows you to your new base, not the other way around.
