You must file within the 90-day window immediately before your conditional green card expires. Filing outside this window — even a day early — can result in rejection unless a waiver applies.
You can still file Form I-751 as a waiver — you do not need your U.S. citizen spouse to co-sign. USCIS allows waiver filings for divorce, legal separation, widowhood, and cases involving battery or extreme cruelty.
Processing times vary widely, but USCIS typically issues a 48-month extension via receipt notice while your case is pending. Some cases are approved without an interview; others are scheduled for one.
