Top Pitfalls That Derail So Many Applications

The Green Card for Parents process has fewer moving parts than other family categories — but the pitfalls that exist are serious. Here are the four most common problems we see before families come to us.

LPR Children Trying to Sponsor

Only U.S. citizens can petition for parents. Lawful permanent residents are not eligible. We confirm your status before anything else.

Petitioner Under Age 21

You must be at least 21 years old to file for a parent. Filing too early gets the petition rejected — we track your eligibility window.

Insufficient Affidavit of Support

A weak I-864 can expose your parent to a public charge finding and denial. We build a thorough financial package that satisfies USCIS standards.

Parent's Prior Immigration Violations

An overstay, prior removal, or unlawful presence in your parent's history can complicate or block approval. We identify these issues early and plan around them.

got questions?

Green Card for Parents — Questions Answered

No. Only U.S. citizens can petition for parents. Lawful permanent residents are not eligible to sponsor parents under any family-based category. We verify your status at the start of every case.
The U.S. citizen petitioner must be at least 21 years old at the time of filing. There is no workaround — the petition will be rejected if filed before age 21.
Parents of U.S. citizens are immediate relatives, which means there is no visa backlog. Consular processing typically takes 12–18 months. Adjustment of Status for parents already in the U.S. may follow a similar or shorter timeline depending on the USCIS service center.
Prior immigration violations can complicate or block the process — but not always. The right strategy depends on the specifics. We assess risk early, identify applicable waivers, and build a plan before filing.
Form I-864 is a legally binding document where you agree to financially support your parent at or above 125% of the federal poverty guidelines. A weak or incomplete I-864 is a leading cause of denial. We handle this carefully so it does not become a problem.
