Priority Date

generalMarriage-Based Green CardGreen Card for ChildrenGreen Card for Parents

Definition

Your place in line for a green card — it's the date your petition was filed, and it determines when you can move forward.

What this actually means

Your priority date is your place in the green card line. It's the date your immigration petition (usually an I-130 or I-140) was filed with USCIS. Think of it like taking a number at the deli counter — you wait until your number is called.

The U.S. only issues a limited number of green cards per year in certain categories. Your priority date determines when it's your turn to get one. When your date becomes "current" (as shown in the monthly Visa Bulletin), you can finally move forward with your green card application.

Why it matters

For immediate relatives of U.S. citizens (spouses, unmarried children under 21, parents), the priority date is basically irrelevant because there's no annual cap — visa numbers are always available. But for everyone else — family preference categories, employment-based categories — the wait can be significant.

Some family preference categories have waits of 5, 10, or even 20+ years depending on your country of birth. That means your priority date, set the day your petition was filed, will determine your timeline for years to come.

Key things to know

  • Check the Visa Bulletin monthly at travel.state.gov to see if your priority date is current
  • Immediate relatives of U.S. citizens don't need to worry about priority dates — no annual caps apply
  • Priority dates can sometimes be "ported" from one petition to another in certain employment-based situations
  • Wait times vary dramatically by category and country of birth — India and China often have the longest backlogs
  • Filing your petition sooner rather than later locks in an earlier priority date, even if approval takes time
